Introduction
These Website Standard Terms and Conditions (the "Terms") govern your use of the Renderfy website, located at https://www.renderfy.co/ (the "Website"). By accessing or using the Website, you acknowledge that you have read, understand, and agree to be bound by the Terms. If you do not agree to the Terms, you may not access or use the Website or our services.
Intellectual Property Rights
The Website and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Renderfy, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
Use of the Website
You may use the Website for lawful purposes only. You may not use the Website:
- In any way that violates any applicable federal, state, local, or international law or regulation.
- To exploit, harm, or attempt to exploit or harm minors by exposing them to inappropriate content, asking for personally identifiable information, or otherwise.
- To transmit or procure the sending of any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
- To impersonate or attempt to impersonate Renderfy, a Renderfy employee, another user, or any other person or entity.
- To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Website, or which, as determined by Renderfy, may harm Renderfy or users of the Website or expose them to liability.
User Content
Users of the Website may submit, upload, or make available content, including but not limited to images, text, and 3D models (collectively referred to as "User Content"). You retain ownership of any intellectual property rights in the User Content. By submitting, uploading, or making User Content available on or through the Website, you grant Renderfy a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media, unless otherwise agreed upon. However, users reserve the right to issue an NDA with Renderfy, which would prevent Renderfy from sharing or discussing the User Content publicly.
User Conduct
You agree to use the Website in compliance with all applicable laws, rules, and regulations. You agree not to engage in any activity that, in Renderfy's sole discretion, disrupts, interferes with, or is harmful to the Website, Renderfy's systems, or other users of the Website.
Trial Terms and Limitations
We offer a 7-day free trial for our renderings subscription services. By signing up for the free trial, you agree to the following terms and limitations:
Scope of the Trial:
a. During the trial period, you will have access to our still rendering services and 3D modeling services for the structure of a building only and 3D modeling assets that already exist. Custom 3D modeling services will not be included.
b. The trial includes three still renderings.
c. One revision for the three still renderings provided during the trial period is allowed.Duration:
a. The free trial period lasts 7 consecutive days from the sign-up date.
b. If you cancel your subscription within the trial period, you will not be charged any fees.Additional Services:
a. Video renderings, virtual tours, and any other services beyond the scope mentioned above are not included in the free trial.
b. If you require additional services or custom 3D modeling, please contact our sales team to discuss options and pricing.Abuse and Misuse:
a. We reserve the right to terminate the free trial and/or refuse future service to any user suspected of abusing or misusing the trial period.
b. Abuse or misuse includes, but is not limited to, attempting to extend the trial period or excessive revision requests.General Terms:
a. The free trial is available to new customers only and is limited to one trial per customer or business entity.
b. Our standard terms of service and privacy policy apply during the trial period.
Participating in our 7-day free trial acknowledges that you have read and agree to these terms and limitations.
Subscription Terms
Our subscription service is billed on a monthly basis and begins on the date of purchase. The subscription will automatically renew on a monthly basis unless canceled by the subscriber. Subscriptions are limited to one user and can be paused or canceled at any time by contacting us through the customer dashboard.
Automatic Renewal
The subscription will automatically renew on a monthly basis unless cancelled by the subscriber.
Limitations of Service
While the number of renderings and revisions is unlimited for our subscription, we can only work on one "Rendering request" at a time.
Termination
We reserve the right to terminate a user's subscription in the event of a violation of these terms of service.
Changes to Subscription
We reserve the right to change the price of the subscription at any time but will give notice to subscribers in advance of any such changes.
Per Project Service
Our "Per Project" service is a one-time payment option for users who require 3D renderings on an occasional basis. Pricing for this service is based on the size of the project, the industry of the project (Architecture, Van life, or Events), and the number of renderings required. Our estimated delivery time for this service ranges from one day to three weeks, depending on the complexity of the project, with the following breakdown for each project type: Small project (1 week), Medium project (2 weeks), Large project (3 weeks), Van life project (1 week). For an additional fee, we also offer rush service with the following rush fee pricing: 20-30% of the total for Small Projects to deliver in less than one week, 30-40% of the total for Medium Projects to deliver less than two weeks, 40-50% of the total for Large Projects to deliver less than three weeks, 20-30% of the total for Van life Projects to deliver in less than one week. We offer 2-4 revisions depending on the size of the project.
Pricing
The final price for the "Per Project" service is calculated at checkout and takes into account the size of the project, the number of renderings, any discounts, and rush fees.
Revisions
We offer 2-4 revisions for the "Per Project" service. Additional revisions are $100 to $300, depending on the size of the project and its complexity.
Payment
Full payment for the "Per Project" service must be made before any work begins and can be made through our website using Stripe.
Service Limitations
Users may request as many revisions as they require; if it exceeds 2-4 revisions, we will charge for additional revisions. Users can request as many renderings as they want, and the price will be adjusted at checkout. There may be times when we cannot accept a rush fee due to high demand.
Termination
We reserve the right to terminate a user's "Per Project" service in the event of a violation of these terms of service.
Changes to Service
We reserve the right to make changes to the "Per Project" service, including pricing and features.
Additional Fine-tuning Service
The fine-tuning service entails making minor adjustments and refinements to the existing assets, such as modifying colors, adjusting lighting, optimizing textures, or making small alterations to the overall composition. It does not cover the creation of entirely new assets or substantial redesigns.
Discretion and Modifications
Renderfy retains the sole discretion to determine the applicability and feasibility of fine-tuning changes. While reasonable efforts will be made to accommodate the client's preferences, Renderfy reserves the right to make professional judgments regarding the execution of fine-tuning adjustments in order to maintain the overall quality and integrity of the assets.
Agreement to the Final Assets
Upon completion of the fine-tuning process, Renderfy will deliver the revised assets to the client. It is the client's responsibility to review the final assets and notify Renderfy of any concerns or required adjustments within the timeframe allotted. Once the client approves the fine-tuned assets or if the timeframe has ended, they will be considered final, and the project will be considered complete.
Additional Services
We offer additional services such as animation, video walk-throughs, virtual tours, 2D renderings, VR, and more for an additional fee. For more information on the pricing and availability of these services, please contact us.
Source File Provision Policy
We do not provide or grant access to the source files used in the creation of the 3D renderings. The final deliverables, including the rendered images or videos, are provided to the customer for their intended use. The source files, which include the original 3D models, textures, and other proprietary assets, remain the intellectual property of Renderfy and are not transferable to the client. This policy helps protect our creative work and ensures the integrity of our rendering process.
Refund Policy
We do not offer refunds for our services, except in cases where we are unable to resolve a technical issue with the service.
Disclaimer of Warranties
The Website is provided on an "as is" and "as available" basis. Renderfy makes no representations or warranties of any kind, express or implied, as to the operation of the Website or the information, content, materials, or products included on the Website. You expressly agree that your use of the Website is at your sole risk.
Limitation of Liability
In no event shall Renderfy, its officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any (i) errors, mistakes, or inaccuracies of content, (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the Website, (iii) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, (iv) any interruption or cessation of transmission to or from the Website, (v) any bugs, viruses, Trojan horses, or the like, which may be transmitted to or through the Website by any third party, and/or (vi) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, transmitted, or otherwise made available via the Website, whether based on warranty, contract, tort, or any other legal theory, and whether or not Renderfy is advised of the possibility of such damages. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.
Indemnification
You agree to defend, indemnify, and hold harmless Renderfy, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Website, including, but not limited to, User Content submitted by you, any use of the Website's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Website.
Governing Law and Jurisdiction
These terms and your use of the Website will be governed by and construed in accordance with the laws of the United States without giving effect to any principles of conflicts of law.
Changes to Terms
Renderfy reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, Renderfy will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at Renderfy's sole discretion.
